The Supreme Court of Nigeria has reinstated Senator Samuel Anyanwu as the National Secretary of the Peoples Democratic Party (PDP) in a unanimous judgment.
The five-member panel ruled that the matter of leadership or membership of a political party is an internal affair and should not be interfered with by the court.
The court overturned the decision of the Appeal Court in Enugu, which had upheld the removal of Anyanwu by a Federal High Court in Enugu on December 20, 2024.
The Supreme Court held that the Federal High Court lacked jurisdiction to hear the matter instituted by Aniagwu Emmanuel.
In its judgment, the Supreme Court also noted that Aniagwu Emmanuel, the plaintiff, lacked the locus standi (legal right) to initiate the action, as he failed to establish how he was directly affected by who occupied the office of the National Secretary of the PDP.
Anyanwu, an ally of Nyesom Wike, FCT minister was said to have been ousted by the party’s caucus in the South East after he ran unsuccessfully for Imo state governorship.
